1. Applicability of the General Terms and Conditions of Sale

1.1 Each order/reservation placed with Mircatto, Unipessoal Lda., VAT No. 515560448, also registered under the same number with the Guimarães Commercial Registry, headquartered at Rua da Sapeira 1, 4805-033 Brito, contact: 253 573 068 (call to national landline) and geral@mircatto.pt ("Mircatto", "website", "we", "mobile application", or "site") via the internet shall be governed by these General Terms and Conditions of Sale. These apply to the exclusion of all other terms. By placing an order/reservation, you acknowledge that you have read, understood, and unreservedly accepted these General Terms and Conditions of Sale.

1.2 By using this website, you agree to be bound by our Terms of Use and Internet Privacy Policy. Mircatto invites you to carefully read these terms before using the services provided on this website.

1.3 Mircatto reserves the right to amend these General Terms and Conditions of Sale at any time by posting a new dated version on this website. By placing an order/reservation after such publication, you agree to be bound by the updated version.

1.4 Some services available on this website are provided by third-party companies contracted by Mircatto, particularly for the transportation of purchased goods.

2. Registration

2.1 When registering on this website, you must ensure that the mandatory information provided is accurate and complete.

2.2 You must promptly update your personal information on the site in the event of any changes, such as your address.

3. Password

3.1 When registering to use this website, you will be asked to create a password. This must be kept strictly confidential and not shared with third parties.

3.2 You are fully responsible for the use of your password and any orders/reservations made using it, even if done without your knowledge.

3.3 If you become aware of or suspect any unauthorized use of your password, you must notify Mircatto immediately by calling 253 573 068 (call to national landline).

4. Orders/Reservations

4.1 By placing an order/reservation through this website, you are making an offer to purchase the selected products under these Terms.

4.2 Mircatto offers its products on this website subject to stock availability.

5. Order/Reservation Confirmations

5.1 Your order/reservation does not constitute a binding contract until confirmed by Mircatto via email.

5.2 Mircatto reserves the right to refuse orders/reservations, particularly in cases of credit issues or outstanding invoices.

5.3 The records kept by Mircatto constitute full proof of the transaction.

6. Scheduled Order/Reservation Service

6.1 “Scheduled Order/Reservation” allows you to automatically reorder based on a chosen frequency.

6.2 These General Terms apply to any Scheduled Order/Reservation unless otherwise stated herein.

6.3 You will receive a written notification 3 days prior to shipment, detailing your basket contents, price, and any stock issues.

6.4 You may cancel your subscription, skip a shipment, or edit your order details at any time free of charge.

6.5 If you cancel a scheduled order by 11:59 PM the day before shipment, you may refuse delivery or return the order if already received.

6.6 If a product is unavailable, Mircatto will notify you but continue with the rest of the order unless canceled.

6.7 You will not be charged for out-of-stock items.

7. Prices

7.1 Product prices include VAT but exclude shipping, which is shown before finalizing your order.

7.2 Shipping costs are calculated based on order size and chosen delivery method.

7.3 Mircatto may change prices and shipping fees at any time and reserves the right to cancel contracts in case of errors.

8. Payment

8.1 Prices include VAT. Discounts are only given by prior agreement.

8.2 Orders can be paid on delivery (cash up to €200) or by debit card.

8.3 Filing a complaint does not suspend payment obligations or justify any deduction.

8.4 Mircatto may refuse orders due to late payments until the debt is cleared.

8.5 Late payments will incur legal interest plus a 5% penalty fee.

9. Late Payment

9.1 Interest and administrative/legal fees apply to overdue balances.

9.2 Mircatto may refuse new orders until full payment is made.

10. Delivery

10.1 Confirmed orders will be delivered to the address specified during checkout.

11. Product Inspection

11.1 You are responsible for checking the quantity and condition of goods upon delivery.

11.2 Damaged or missing items must be reported to the carrier and Mircatto within 7 days.

12. Returns/Exchanges

12.1 Orders will be delivered to the customer’s indicated address, with partial shipping costs borne by the customer.

12.2 It is the customer’s responsibility to inspect goods at delivery.

12.3 Any claims must be submitted within 7 days of delivery.

12.4 The right of withdrawal does not apply to food products.

13. Limitation of Liability

13.1 Product texts and images are non-contractual and for informational purposes only.

13.2 Claims are limited to the purchase price of the disputed product.

13.3 Mircatto is not liable for indirect or consequential damages of any kind.

13.4 Liability for loss or damage from breach of these Terms is expressly excluded.

13.5 Nothing excludes liability for: (i) death or personal injury due to negligence; (ii) fraud or fraudulent misrepresentation; (iii) defective products; or (iv) any other matter which cannot legally be excluded.

15. Force Majeure

15.1 Mircatto will make all reasonable efforts to fulfill obligations but is not liable for delays caused by circumstances beyond its control (e.g., strikes, war, natural disasters).

15.2 In case of delay, Mircatto will fulfill obligations as soon as reasonably possible and may distribute remaining products fairly among customers.

16. Applicable Law and Jurisdiction

16.1 These Terms are governed by Portuguese law, and disputes shall be submitted to the exclusive jurisdiction of Portuguese courts.

16.2 For disputes arising from online purchases, you may file a complaint at the EU ODR platform: https://ec.europa.eu/odr.

16.3 Alternatively, you may contact one of the listed Consumer Dispute Resolution Centers.
